Biometric Privacy Perils Grow After BNSF Loses Landmark Verdict
Bloomberg Law: Will biometric privacy class action (BIPA) violations encourage more litigation in Illinois? Illinois is the only state that allows employees and consumers to sue based on capturing facial scans, voiceprints and other biometric data unlawfully. BNSF Railway Co was found guilty of violating the state’s Biometric Information Privacy Act by collecting more than 45,000 truck drivers fingerprints as a form of identity verification without obtaining proper consent. The company is ordered to pay an astonishing $228 million dollars but they plan to appeal.
